Terms of Use

These are the rules for using Gavel. They're shorter than most. The gist: be decent, understand that an appraisal is an estimate, and accept that we're human and sometimes wrong.

Gavel ("the App") is developed by MO Horizons LLC ("we", "our", "us"). By downloading or using the App, you agree to these terms. If you don't, please don't use it.

1. What Gavel is

Gavel is an iOS application that turns a photograph of an antique, collectible, or piece of art into an estimated appraisal — name, era, condition, and a market value range based on public marketplace comparables.

2. What an appraisal is not

Gavel's verdicts are estimates, not guarantees. They are not:

  • A professional appraisal for insurance, tax, or estate purposes.
  • An authentication of an artwork or signature.
  • A legal valuation for probate or court use.
  • Financial or investment advice.

If you're about to act on real money — insuring a piece, selling at auction, paying an inheritance tax — please also consult a certified appraiser or an auction house.

3. Subscriptions and auto-renewal

Your first appraisal is free. Beyond that, Gavel is a paid subscription sold through the Apple App Store. Prices are shown in the App and on the App Store page.

Subscription length and price are shown on the purchase screen before you confirm.

Auto-renewal. Payment is charged to your Apple ID at confirmation of purchase. A subscription automatically renews at the same price and duration at the end of each period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.

Free appraisal to paid subscription. If you use your free appraisal and then subscribe, your paid subscription begins immediately at checkout and renews automatically as described above.

Managing your subscription. You can manage your subscription and turn off auto-renewal in iOS Settings → [your name] → Subscriptions after purchase.

4. Refunds

Refunds on App Store purchases are handled by Apple, not by us. You can request one at reportaproblem.apple.com. If Apple declines and you believe you were treated unfairly, write to us and we'll advocate where we can.

5. Acceptable use

You agree not to use Gavel to:

  • Appraise stolen property, or anything you know you cannot legally sell.
  • Misrepresent a Gavel estimate as a certified or professional appraisal.
  • Scrape, flood, or reverse-engineer the service, or otherwise interfere with its operation.
  • Violate any applicable law in connection with your use of the App.

6. Ownership

You own your photographs, your notes, and your collection. We own the App, the brand, the code, and the design. You grant us a limited, short-lived right to process your photograph solely for the purpose of producing an appraisal — see our Privacy Policy.

7. Disclaimer of warranties

Gavel is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the App will be uninterrupted, error-free, or that any appraisal will be accurate.

8. Limitation of liability

To the fullest extent permitted by law, MO Horizons LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the App. Our total aggregate liability for any claim arising out of or relating to the App is limited to the amount you paid us in the twelve months preceding the claim. In plain terms: if your subscription breaks, our liability is the cost of your subscription.

9. Termination

We may suspend or terminate your access to the App if you materially breach these terms. You may terminate at any time by deleting the App and cancelling your subscription through Apple.

10. Changes to these terms

We may update these terms. If the change is substantive, we'll tell you — in the App, or by updating the "Last updated" date above. Continued use after a change means you accept the revised terms.

11. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws of your home jurisdiction grant you rights that cannot be waived — in which case those laws apply.
